Welcome to TravBudd™ (“we,” “our,” or “us”) Terms and Conditions of Use. By accessing or using TravBudd™, our websites, or services (“site,” “sites,” “website,” “websites,” “service,” “services,” “platform,” “platforms,” “system,” or “systems”), you agree to comply with and be bound by these Terms and Conditions of Use (“Terms” or “Agreement”), including our Privacy Policy, and our Community Guidelines. If you do not agree with any part of these, please do not use or access TravBudd™, our websites, or services. Before you create an account on TravBudd™, ensure you are eligible to use our services.

As used in this Agreement, the terms “TravBudd™,” “our,” “us,” and “we,” shall refer to TravBudd LLC. These Terms constitute a binding legal agreement between you (“user,” or “users”) and TravBudd LLC.

We may update or modify these Terms at any time without notice. It is your responsibility to review these Terms periodically, and by continuing to use TravBudd™ or our services, you accept any changes or modifications.

 

All content on TravBudd™, including text, graphics, logos, and images, is our intellectual property and may not be used without permission.

1. Eligibility

You must be at least 18 years old to use TravBudd™. You are not authorized to access, create an account, or use TravBudd™ or our services unless all of the following are true, and by using our services, you represent and warrant that:

• You are at least 18 years old and have the legal capacity to enter into these Terms;

​

• You have not committed, been convicted of, or pled no contest to a felony or indictable offense (or crime of similar severity), a sex crime, or any crime involving violence or a threat of violence, unless you have received clemency for a non-violent crime and we have determined that you are not likely to pose a threat to other users of our services;

​

• You are not prohibited by law from using our services;

​

• You are not required to register as a sex offender with any state, federal or local sex offender registry.

 

If at any time you cease to meet these requirements, all authorization to access our services or systems is automatically revoked, and you must immediately delete your account, and we retain the right to remove your access to our services without warning.

2. User Conduct

You agree to provide accurate and truthful information while using TravBudd™. You are responsible for maintaining the confidentiality of your account information and you are solely responsible for all activities that occur under your account.

You agree to:

• Comply with these Terms, and check this page periodically to ensure you are aware of any changes or updates;

​

• Use your real name, real images of yourself, and your real age in creating your TravBudd™ account, on your profile, while selecting and submitting your events and experiences, and while using our services;

​

• Present yourself respectfully and authentically both on and off our services;

​

• Use TravBudd™ in a professional manner;

​

• Treat other TravBudd™users in a courteous and respectful manner, both on and off our services;

​

• Abide by our Community Guidelines;

​

• Be respectful when communicating with any of our customer service representatives or other employees;

​

• Comply with all applicable laws, including without limitation, privacy laws, intellectual property laws, anti-spam laws, equal opportunity laws, and regulatory requirements;

 

You agree that you will not:

 

• Misrepresent your identity, age, current or previous positions, qualifications, or affiliations with a person or entity;

​

• Impersonate another person or create a false identity;

​

• Act in an unlawful or unprofessional manner including being dishonest, abusive or discriminatory;

​

• Solicit money or other items of value from another user, whether as a gift, loan, or form of compensation;

​

• Harass, bully, stalk, intimidate, assault, defame, harm or otherwise mistreat any person or TravBudd™ user;

​

• Use our services for any harmful, illegal, or nefarious purpose;

​

• Create a new account after we suspend or terminate your account, unless you receive our express permission;

​

• Create or operate a pyramid scheme, fraud or other similar practice;

​

• Develop, support or use software, devices, scripts, robots, other types of mobile code or any other means or processes (including crawlers, browser plugins and add-on or other technology) to scrape or otherwise exfiltrate from TravBudd™ or its services, or otherwise copy profiles and other data from the services;

​

• Modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of our services, or cause others to do so;

​

• Upload viruses or other malicious code or otherwise compromise the security of our services;

​

• Copy, modify, transmit, distribute, or create any derivative works from, any user or our content, or any copyrighted material, images, trademarks, trade names, service marks, or other intellectual property, content or proprietary information accessible through our services without TravBudd™’s prior written consent.

 

We reserve the right to suspend or terminate accounts that violate our User Conduct. All content on TravBudd™, including text, graphics, logos, and images, is our intellectual property and may not be used without permission.

3. Content Guidelines

You are solely responsible for the content you post on TravBudd™. By submitting any content, including but not limited to profiles, photos, text, and messages, you grant TravBudd™ a worldwide, non-exclusive, royalty-free license to use, copy, display, and distribute such content.

Prohibited content includes, but is not limited to, nudity, explicit or offensive material, hate speech, and illegal activities. We reserve the right to remove or restrict access to content that violates our guidelines.

4. Privacy

Your privacy is important to us. Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using our services, you consent to the terms of our Privacy Policy.

5. Payments, Memberships, and Subscriptions

TravBudd™ offers three match memberships: Platonic, Romantic, and Both. Each match membership has a different subscription price. You agree to pay the prices displayed to you for the services you’ve selected as well as any sales or similar taxes that may be imposed on your payments (and as may change from time to time), and you authorize TravBudd™ to charge the payment method you provide (your “Payment Method”).

 

TravBudd™ may correct any billing errors or mistakes even if we have already requested or received payment. If you initiate a chargeback or otherwise reverse a payment made with your Payment Method, TravBudd™ may terminate your account immediately in its sole discretion, on the basis that you have determined that you do not want a TravBudd™ subscription or do not want to use our services. Subscriptions automatically renew until you cancel.

Cancelling a Subscription

To cancel a subscription, please contact us at info@TravBudd.com with the subject line “Cancel Subscription”. Provide your first and last name, email, phone, and the subscription (“Platonic,” “Romantic,” or “Both”) you want canceled. Please allow us at least 3 business days to process your request.

If you cancel a subscription, you may continue to use the cancelled service until the end of your then-current subscription term. The subscription will not be renewed when your then-current term expires.

6. Events and Experiences

You are responsible for verifying the dates, locations, and times of your chosen events and experiences. Submitted events and experiences can not be changed.

Chosen events and experiences must be submitted at least 24 hours before their start time in order to receive a potential match for the event or experience. We strongly recommend submitting your chosen events and experiences at least 48 to 72 hours, or more, prior to their start time in order to get the best possible matches.

 

Events and Experiences Ticket or Access Cost and Payment

TravBudd™ users are responsible for the entire ticket or access cost of their chosen events and experiences, including any taxes and service fees associated with the event or experience. Payment must be made through authorized payment methods. We use a secure payment method to protect your financial information.

 

Part of the process of accepting and confirming a match with a follow TravBudd™ user is paying for your event ticket. Payments are made through a TravBudd™ provided link. We place a hold of the total cost of your event or experience ticket, including any taxes and service fees, on your card once you confirm your match.

 

Matches have to be mutually accepted and confirmed for users to be connected. If matches are not mutually accepted and confirmed in the allotted time (12 hours), the match is canceled. If TravBudd™ is unable to secure a mutual match for a user for a chosen event or experience, the ticket cost is refunded.

 

TravBudd™ users have 12 hours from the time they are notified of a match to review, accept, and confirm the match, or lose it. TravBudd™ users who mutually accept and confirm a match are charged for their respective event or experience ticket.

 

Once matches are mutually accepted and confirmed, ticket costs are non-refundable.

 

Tickets are subject to availability. Ticket prices are subject to change without notice. All sales are final; no refunds or exchanges, unless specified otherwise.

 

Once matches are mutually accepted and confirmed, TravBudd™ will send the event tickets and instructions to the matched individuals, including instructions on how to get connected.

 

Event or Experience Cancellation or Changes

We are not responsible for event or experience cancellations or changes. Refunds or exchanges due to event or experience changes or cancellations are at the discretion of the event organizer.

7.  Safety

While we strive to create a safe community, TravBudd™ cannot guarantee the actions of its users. We still urge our users to be mindful when meeting and interacting with other users. Be open but also employ wisdom in your interactions. It is important to take necessary precautions and report any suspicious or inappropriate behavior to us. Please review our Community Guidelines for additional information.

• Always meet your mutually accepted and confirmed TravBudd™ match in a populated, public place and stay in a populated, public place.

 

 

• Inform friends or family of your plans, including where you’re going, when you’re going, what you’re wearing, the name of the person you’re meeting, and when you expect to return home. Have your cell phone charged and with you at all times.

 

 

• Be in control of your transportation, including how you get to and from your chosen event or experience. Always have a backup transportation plan, such as a ride-share app or a friend to pick you up, in the event your original transportation plan does not work out.

 

 

• Be aware of your personal surroundings. Do not leave drinks, food, or personal items unattended. Know where your drink or food comes from and know where it is at all times. Only accept drinks or food poured or served directly from the bartender or server. Many substances that are slipped into drinks to facilitate sexual assault are odorless, colorless, and tasteless. Also, keep your phone, purse, wallet, personal belongings, and anything containing personal information on you at all times.

 

 

• Be aware of the effects of drugs or alcohol on you. These substances can impair your judgment and your alertness. If a TravBudd™ user tries to pressure you to use drugs or drink more than you’re comfortable with, stand your ground and end the interaction immediately.

 

 

• If you feel uncomfortable at any moment during the meetup or while sharing an experience with a follow TravBudd™ user, end the interaction immediately. Trust your instincts. If something is off or you feel unsafe, ask someone around for help, ask the event or location security for help, ask a bartender or server for help.

 

 

• Your safety is important to us. Please take precautions when interacting with others. Report any suspicious or inappropriate behavior to local authorities immediately.

8. No Criminal Background Checks or Identity Verification Checks

TravBudd™ does not conduct criminal background checks or identity verification checks on users. Please employ wisdom and your best judgment when interacting with others. Review our Community Guidelines and the Safety section of this Terms agreement.

You are solely responsible for your interactions with other users.

9.  Termination

We reserve the right to suspend or terminate your account or use of TravBudd™ at any time for any reason, with or without notice. You may also terminate your account at any time by contacting us at info@TravBudd.com with the subject line “Terminate Account”. Please include your first and last name, phone number, and email.

10. Disclaimers

We provide our services “as is” and without any warranty or condition, express, implied, or statutory. TravBudd™ is not responsible for the conduct of users or the accuracy of user-provided content.


11. Limitation of Liability

TravBudd™ or its owners shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages resulting from your access or use of our services.


12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Indiana, U.S.A. Any disputes arising from or in connection with this agreement shall be resolved in the courts of Indiana, U.S.A.


13. Modifications

We may update or modify these Terms from time to time. It is your responsibility to review these terms periodically, and by continuing to use TravBudd™, you accept any changes or modifications.


14. Acceptance of Terms

By accessing or using TravBudd™, you accept these Terms, including our Privacy Policy, and our Community Guidelines. You agree to comply with and be bound by these Terms, including our Privacy Policy, and our Community Guidelines. If you do not agree with any part of these, please do not use or access TravBudd™, our websites, or services.
